Louisiana state courts have recently reaffirmed their recognition of Assignment of Benefits (AOB) under Louisiana law and jurisprudence. This development comes in the aftermath of the devastating Hurricanes Laura, Delta, and Ida. Homeowners relying on their insurance policies expected their insurance company to directly pay their contractors under the AOB provisions in the contract they had signed. However, big insurance companies challenged the validity of AOB’s, sparking disputes among homeowners and contractors in an apparent attempt to pit the parties against each other and away from the insurance company.
